How long will it take?

This is a hard question to answer as it includes a number of factors including the length of the chain from buyers and sellers, is the property that is being sold leasehold and the type or purchase and sale of property. The best thing to do is not plan a specific date to move as delays can happen and your solicitor has no control of these factors. When the exchange of contracts has gone through you have more of an idea on time. The process can take from 6 to 10 weeks.

What is conveyancing?

Conveyancing is a legal process in which the ownership of a property is transferred.  


What is the process of buying a property through Conveyance Consult?

•  The instructions you have given us are held and we contact the sellers solicitor for their documents

•  Enquiries are carried out, title investigation and other searches

•  We receive your mortgage from your mortgage lender

•  We report your for you to sign the contract, transfer and mortgage deed

•  Any shortfall is requested from you to complete the purchase of the property

•  Contracts are now exchanged and a date you can move in is finalised

•  Final documents are signed by you

•  Your mortgage loan is received from your mortgage lender

•  Completion happens and you move in to your new property

•  The transfer is stamped

•  The title is registered with the land registry and the deeds are sent to your mortgage lender


What is the process of selling a property through Conveyance Consult?

•  The instructions you have given us are held and we request your title deeds from your lender

•  Copies of your title are obtained from the land registry

•  The sales instructions are received from your estate agent

•  The contracts and your title details are sent to the buyers solicitor

•  Any questions the buyer has answered

•  Contracts are now exchanged and a date you move out are finalised

•  Final documentation is prepared and signed

•  The figure of money is obtained from your lender which you can use to pay off your current mortgage

•  Completion happens and you move out of your property

•  The title deeds are sent to the buyers solicitor


Must I use a lawyer?

It's to you - you can do some of the work yourself but the bits you pay for will be done by others so you're really instructing a lawyer to do it for you. A lawyer has to draft the contract or transfer - as the law says 'anyone seeking money for this must be qualified, regulated, and insured.


Why are conveyancing costs different for buyers and sellers?

When you purchase any property you have to pay extra costs for searches, inspections, Government Stamp Duty and the transfer of ownership which has fees connected.


What is exchange of contracts?

A contract for the sale of the land has to be in writing in English Law, both the buyer and seller sign a separate copy of the written contract. Then the buyer's solicitor and seller solicitor exchange these contracts one has the other and other has the one. This exchange of contracts is usually done over the telephone when this happens the contract is a legal, binding document. A physical version of the exchange of contracts happens a few days later, via post.
